Background

Republic Act No. 10173, also referred to as the Data Privacy Act of 2012 (DPA),is a law designed to safeguard personal information in both government and private sector information and communication systems.It established the National Privacy Commission (NPC), responsible for overseeing the law's enforcement. The DPA regulates the processing of personal and sensitive personal information, emphasizing that such activities require the explicit consent of the data subject.

The law mandates all government and private organizations handling personal data to create policies and implement procedures that ensure the protection and security of personal data under their control or custody. These measures aim to uphold individuals' data privacy rights and safeguard personal information from risks such as accidental loss, destruction, unlawful access, fraudulent misuse, unauthorized alteration, or contamination.

To ensure compliance and transparency, organizations are required to prepare a Privacy Manual. This document serves as a guide to implementing the DPA, its Implementing Rules and Regulations (IRR), and other directives from the NPC. It outlines the organization's privacy and data protection protocols, detailing the steps to be followed at every stage of data management, from collection to destruction.
